How GDPR affects the international hosting market?
In May 2018, Europe switched to the updated rules for processing personal data, established by General Data Protection Regulation. The new regulations provide EU residents with the tools to fully control their personal data. We analyzed new rules for the processing of personal data in the EU and formulated recommendations for companies on how to respond to the GDPR.
Who is in the area of the GDPR?
The GDPR has an extraterritorial effect and is applied to all companies that process personal data of residents and EU citizens, regardless of the location of such a company.
Which organization should comply with the GDPR?
If you provide services and goods to EU residents you need to act in terms of GDPR, because:
- services / goods are adapted to the local languages of EU residents;
- services / goods are paid in local EU currencies;
- services / goods are provided on national top-level domains of EU countries.
And what if company does not trade with EU residents?
It is important to note that in addition to processing personal data in the GDPR, the concept of monitoring the behavior of data subjects is used. The GDPR applies to organizations established outside the EU, if they (as a controller or processor) control the behavior of EU residents.
Monitoring can include:
- tracking the EU resident on the Internet;
- the use of data processing methods for the profiling of individuals, their behavior or their relation to anything.
As we see, all representatives of the hosting market fall under the framework of the GDPR regulation and should have already introduced a number of changes in order to meet the requirements. It is especially worth noting that the reform restores the confidence of the user-consumer, which allows the business to make maximum use of the opportunities on the European digital market. The collection, analysis and movement of personal data around the world have acquired enormous economic importance. Personal data is the "currency" of the modern economy. And if you as a data center collect user’s data, you must carefully monitor its safety.
